All services provided by PlushMedia are subject to the following terms and conditions. By purchasing design services from PlushMedia, you are agreeing to these conditions:
All Sales are Final. Due to the digital nature of this business, no refunds will be given. There are no exchanges or refunds for any reason, before or after services/projects have been delivered. This applies to: custom web design projects, packaged projects, web design templates, print design projects, logos, and any other add on service ordered.
Turnaround. PlushMedia’s goal is to deliver very high quality work in a timely manner. Project turnaround time depends on the size of your project and the current workload, and can be delivered anywhere from 5 business days or less, to 8 weeks or longer. This will be discussed prior to agreeing to create your project with you.
PlushMedia works with multiple clients at a time, and although we are able to work on several client projects at once – we do keep clients in order of first come, first serve. If you are in a hurry and need something done within a very short timeframe, we offer “Rush” priced projects – there is more information about our Rush Project policies further below.
Once it is agreed to begin a project and content is requested, the sooner everything needed to complete your project is delivered, the sooner your project will be completed.

Delays due to the client not providing essential items needed to complete their project are not PlushMedia’s responsibility.

At the time content is requested, after 2 business days, if no content has been provided you will be placed back in line behind projects on our current design calendar before work is resumed. If no contact regarding content is made within 7 business days the project will be considered expired. Waiting list placement, and project expiration require no prior notice.
Payment. All web projects priced at a packaged rate must be paid in full prior to beginning. Half due upon booking your design slot, and the other half due two business days prior to your start date.
Additional charges will be applied if the client needs additional work/services that are outside of the original quote, project scope, or package specifications.
PlushMedia will not upload web projects to a server other than our own, or complete final round of revisions until your project is paid in full.
Print design graphics (logos, flyers, brochures, product tag designs, etc), and print design packages must be paid in full before PlushMedia will begin.
If a packaged project expands beyond the scope of initial package purchased, you will be notified and billed at an a la carte rate for added revisions, and other add-on features.
PlushMedia accepts credit/debit card payments via PayPal or Square.
Rush Fees. If you would like to request that an express rush be applied to any project for any reason, PlushMedia will try fit you in between currently scheduled projects if the current workload/schedule permits for an additional fee. If you would like to push a current project ahead of normally scheduled completion for any reason, a rush fee will be applied.
The full balance of a rushed project is due before PlushMedia will begin. This fee is determined based on the size of your project, and time-frame it needs to be completed in.

If PlushMedia isn’t provided the content needed to begin a rush project within 5 business days of rush project payment, your project will no longer be considered a rush project.

After 10 business days, your project will be considered expired.

Rush fees will not be refunded.
E-Commerce. The client agrees that the client is solely responsible for complying with any laws, taxes, and tariffs applicable in any way to the web design project and will hold harmless, protect, and defend PlushMedia from any claim, suit, penalty, tax, fine, or tariff arising from the client’s exercise of Internet electronic commerce.
Design Credit/Copyright. PlushMedia reserves the right to place a small logo, or “Designed By PlushMedia” text on any web projects. This will be done very discreetly and customized to match the layout without standing out. The logo may not be removed, and in any case that it is will be considered a violation of our terms and become subject to removal of the entire website design. If you would rather not have a PlushMedia logo added, an additional copyright fee will be charged.
PlushMedia retains the right to display graphics and other web design elements as examples of their work in their respective portfolios.
PlushMedia is not accountable for any photographs of digital elements provided by clients. It is assumed that if you are providing PlushMedia with an image to use that you have attained the proper permissions from the rightful owner.
Nothing posted on this website is public domain. Designs created by PlushMedia may not be altered, cut up, modified, re-used or re-distributed in any way without PlushMedia’s explicit written consent. PlushMedia’s work may not be passed off as your, or anyone elses work.
Legal Notice. Notwithstanding anything to the contrary contained in this contract, PlushMedia cannot warrant that the functions contained in the Web Design Project will be uninterrupted or error-free. The entire risk as to the quality and performance of the Web Design Project is with the Client. In no event will PlushMedia be liable to the Client or any third party for any damages, including, but not limited to, service interruptions caused by Acts of God, the Hosting Service or any other circumstances beyond our reasonable control, any lost profits, lost savings or other incidental, consequential, punitive, or special damages arising out of the operation of or inability to operate this Web Design Project, failure of any service provider, of any telecommunications carrier, of the internet backbone, of any internet servers, your or your site visitor’s computer or internet software.
Support and Communication. You will receive e-mail/technical support for 15 days after your site has been turned over to you, unless otherwise is specified in your specific package purchase. PlushMedia encourages you to use this time to become familiar with the functionality of your site. After 15 days, there may be a charge for hourly technical support depending on the frequency, and complexity of your questions. Please note that all of our communication will be through e-mail.
E-mail is PlushMedia’s preferred primary method of contact because it helps to keep an electronic record of all communication with clients. While we know that some people just feel more comfortable talking to a designer via telephone, we do ask that all of your requests for design be made “in writing” via email. This is to protect both you and PlushMedia from miscommunication and so that everyone has a paper trail of all conversations. PlushMedia often works on more than one project at a time, and the “written requests” really help to keep each job organized.
Chargebacks/Disputes. PlushMedia will not negotiate chargebacks with any person or company. Chargebacks are NEVER acceptable means of attaining a refund. To request a chargeback on your credit card for a valid transaction is considered fraud. Fraudulent credit card chargebacks will be aggressively prosecuted and reported to all major credit bureaus as a delinquent collection account. Should a chargeback be filed against PlushMedia, we will not hesitate to proceed with legal action to recover funds. Filing fraudulent disputes will result in suspension, or termination of your project at PlushMedia’s discretion.
Acceptance. Please note that by submitting your payment for any services you are agreeing to all of the terms of service as written here. PlushMedia reserves the right to change or update these terms at any time without prior notice.
It is the client’s responsibility to make sure they have read, understand, and comply with PlushMedia’s Terms prior to purchasing any services.
